Laws and rules that actually decide what you can use

30% tax on virtual digital asset gains

Section 115BBH of the Income Tax Act taxes gains on virtual digital assets at 30% with no loss offset. Spending crypto on a card is a disposal, so each purchase can be a taxable event.

1% TDS under Section 194S

A 1% tax deducted at source applies to transfers of virtual digital assets above the statutory threshold. Frequent card spending multiplies this friction.

LRS and TCS on outward remittance

The Liberalised Remittance Scheme caps outward remittance at USD 250,000 per financial year, and tax collected at source applies to international card spending above the annual threshold.

PMLA reporting for crypto service providers

Since 2023, virtual digital asset service providers are reporting entities under the Prevention of Money Laundering Act and must register with FIU-IND.

Practical notes

  • Expect PAN and often Aadhaar based verification on any issuer that accepts Indian residency.
  • Stablecoin funding avoids the banking rails, but the tax event still occurs at the point of spend.
  • Keep a transaction export, reconstructing per-purchase cost basis later is painful.
